This Privacy Policy describes how AgileTrack Software, LLC collects, uses, and shares personal information when you visit fotomedley.com, create an account, upload or create content, use FotoMedley services, or make a purchase from the "Site".

We collect information you provide directly, information created through your use of FotoMedley, and information collected automatically when you use the Site.

Information you provide may include account details, contact information, profile settings, communication preferences, support messages, order details, payment-related records, shipping or fulfillment information, and any other information you choose to submit.

Content you upload, create, or save through FotoMedley may include photos, images, project files, prompts, style selections, captions, labels, collection details, book details, generated outputs, and information contained in or associated with that content. Depending on what you upload and how it was created, this may include metadata such as file names, dates, device or camera information, location information, image characteristics, and other embedded or derived information.

We also collect information automatically, such as IP address, browser and device information, time zone, referring pages, pages viewed, interactions with the Site, approximate location derived from network information, session data, cookies, local storage, session storage, log files, and similar technologies.

When we refer to "Personal Information" in this Privacy Policy, we mean information that identifies, relates to, describes, or could reasonably be associated with a person, account, device, upload, project, order, or interaction with FotoMedley.

We also collect server-side usage, performance, security, and operational analytics data through our app server and internal systems. This may include account identifiers, IP address, browser and device information, timestamps, pages or features used, project or job identifiers, credit and purchase events, upload and generation workflow events, error logs, performance data, moderation or abuse-prevention signals, and related metadata.

We use Personal Information to provide, operate, secure, and improve FotoMedley. This includes creating and managing accounts, authenticating users, processing uploads, saving projects, generating and displaying creative outputs, performing content analysis and moderation, providing image processing features, fulfilling orders, processing payments, managing credits or subscriptions, communicating with you, providing support, detecting abuse or fraud, troubleshooting, maintaining security, improving our products, measuring site performance, and complying with legal or business obligations.

We may also use Personal Information to personalize your experience, remember preferences, provide product updates, send marketing communications where permitted by law and consistent with your preferences, evaluate marketing campaigns, and understand how people use FotoMedley.

Server-side usage and operational analytics are a required part of the Service. We use them to operate, secure, maintain, troubleshoot, support, bill for, measure, and improve FotoMedley; prevent fraud or abuse; enforce our Terms; and understand reliability and feature usage.

We do not currently use separate analytics cookies, tracking pixels, or third-party on-page analytics scripts for this required operational analytics. We do not use operational analytics for third-party advertising, cross-context behavioral advertising, or AI model training.

We may store operational analytics in logs, reporting systems, or analytics databases, and we may aggregate or de-identify it for reporting, reliability, product planning, security, and business records.

FotoMedley may process uploaded content and related information using internal systems and third-party service providers, including AI technology providers. This processing may include content analysis, content moderation, image processing, generation of new creative outputs, quality checks, and related service functionality. We do not use user uploads or generated outputs to train AI models, and we require AI technology providers that process content for us not to use that content to train their models.

We attempt to enforce our content and safety policies, but automated and human review may not identify every issue. FotoMedley generally cannot determine whether user-uploaded content infringes intellectual property, privacy, publicity, or other rights. You should only upload content that you have the right to use and that you are comfortable having processed for these purposes.

We use third-party payment processors to process payments. We do not intend to store full payment card numbers on FotoMedley systems. We may store payment-related, order-related, subscription-related, credit-related, and fulfillment-related information so we can complete purchases, provide support, manage subscriptions, prevent fraud, maintain business records, process refunds, and fulfill physical or digital orders.

We share Personal Information with service providers and business partners that help us operate the Site and provide our services. These may include hosting and storage providers, payment processors, authentication providers, email and communication providers, analytics providers if enabled in the future, fulfillment and shipping providers, customer support tools, security tools, content moderation providers, and AI technology providers.

We may also share Personal Information to comply with applicable laws and regulations, respond to a subpoena, search warrant, court order, or other lawful request for information, enforce our agreements and policies, detect or prevent fraud or abuse, protect the rights, property, or safety of FotoMedley, our users, or others, or in connection with a business transaction such as a merger, acquisition, financing, reorganization, or sale of assets.

• We do not use user uploads or Generated Outputs to train AI models.
• We require service providers that process user uploads or Generated Outputs for us not to use that content to train their models.

FotoMedley is operated by AgileTrack Software, LLC from the United States. If you access the Site from outside the United States, your Personal Information may be collected, used, stored, processed, and transferred in the United States and other countries where we or our service providers operate. Those countries may have privacy and data-protection laws that differ from the laws where you live.

Where required by applicable law, we will use appropriate safeguards for cross-border transfers of Personal Information. By using the Site or providing Personal Information, you understand that your information may be transferred to, processed in, and stored in countries outside your country of residence.

We currently use only cookies, local storage, session storage, log files, and similar technologies that are necessary to operate the Site, keep you signed in, remember preferences, support shopping and checkout flows, maintain security, prevent fraud or abuse, and provide requested Service functionality.

We do not currently use advertiser cookies. We may add optional analytics or measurement technologies in the future to understand usage and improve the Site. Where required by law, we will provide notice and obtain any required consent before using optional analytics, measurement, advertising, or other non-essential technologies.

Some browser or device settings may limit cookies or similar technologies, but disabling necessary cookies or storage may affect Site functionality.

Please note that we do not alter our Site's data collection and use practices when we see a Do Not Track signal from your browser.

You may delete your account at your discretion through the account deletion process we provide or by contacting us. Deleting your account may remove access to your account, projects, uploads, generated outputs, credits, subscriptions, and related services.

If you are located in the European Economic Area, United Kingdom, Switzerland, or another region with similar requirements, we process Personal Information to fulfill contracts we may have with you, to pursue legitimate business interests, to comply with legal obligations, and with consent where required. We may ask you to verify your identity before responding to a request, and we may deny or limit requests where allowed by law, including where information must be retained for legal, security, fraud-prevention, accounting, dispute-resolution, or operational reasons.

We keep Personal Information for as long as needed to provide the services, maintain your account, complete transactions, operate and secure FotoMedley, comply with legal obligations, resolve disputes, enforce our agreements, and maintain appropriate business records.

When your account is deleted, we will delete, purge, or anonymize account information and user-generated content where reasonably possible. Some information may remain where retention is necessary for legal, tax, accounting, security, fraud-prevention, dispute-resolution, backup, audit, or legitimate business purposes. Records related to completed purchases, payment processing, subscriptions, fulfillment, refunds, security events, and legal compliance may be retained even after account deletion.

Deleting your account may not remove information already processed by third-party providers, included in completed orders, retained in backups for a limited period, or stored locally in your browser. You may need to clear your browser storage to remove locally saved drafts or preferences.

The Site is not intended for children under 13 to create accounts or use the Site on their own. Accounts and purchases must be created by adults or by users old enough to form a binding contract where they live. Minors may use FotoMedley only with the involvement and permission of a parent or legal guardian. Parents or legal guardians may use FotoMedley to create projects involving family photos or photos of minors if they have the necessary rights and permissions.

If you believe a child under 13 has provided Personal Information directly to us without appropriate permission, contact us and we will take reasonable steps to delete that information.

We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons.
